The Procurement Law Intensive is a two day programme designed to give the participant a focused and comprehensive appreciation of procurement law developments. This course is information intensive offering a global perspective on the legal developments that are reshaping the way that Governments and the private sector do business worldwide. The Procurement Law Intensive exposes the participant to the latest and most advanced Common Law developments in Procurement Law thereby arming Caribbean professionals with the experienced insights needed to survive the fast-paced, high-risk, rapidly evolving world of government and private sector procurement. Rather than focusing on the boardroom and the courthouse the course offers practical approaches on how companies can re-align legal service delivery to maximize their return on investment.

  • distil core concepts from years of intensive research covering case law developments over the last quarter century with specific emphasis on Canadian case law;
     
  • survey an international spectrum of developments in the world of government procurement, including advanced tendering formats and evolving governance frameworks; and

Day One entitled "Procurement Law Fundamentals" covers the following topics:

  • Developing Caribbean Procurement Law
  • Governing Principles & Institutional Strategies
  • Overview and Implication of the "Contract A" procurement paradigm/ "Process contract" in Privy Council decision of Pratt Contractors 2004.
  • Five Major Implied Duties
  • Ethics & Accountability Case Studies
  • Legal risk methodologies for major projects and high profile procurements

Day Two entitled "Advanced Procurement Law Workshop" includes highly interactive sessions and workshops where participants will build on the information learned on the previous day in the context of challenging fact scenarios. Focus in these sessions will be given to the participants expressed concerns and needs. The following topics will be covered:

  • Critical Trends in Procurement Law
  • Choosing the right Procurement format
  • Precision Drafting Concepts - which introduces a step-by-step method for accelerated drafting and improved document quality
  • Implied duties v Reserved Rights - an exploration of the interplay between implied fairness duties and expressly reserved rights
  • Key concepts and methodologies for the contract management phase
